Privacy Policy – Ed Silk Real Estate

1. Our Commitment to Privacy

Ed Silk Byron Bay (“we”, “us”, or “our”) is dedicated to protecting your personal information. We operate in strict accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (AML/CTF), including the 2026 Regulatory Reforms.

2. Collection of Information & Consent

We collect personal information (name, email, and mobile number) to respond to your enquiries and provide real estate services.

  • Granular Consent: By submitting an enquiry on our website, you provide express consent for us to use your contact details for that specific purpose.
  • Withdrawal of Consent: You may “opt-out” of communications at any time via the “Unsubscribe” link in our emails or by contacting our Privacy Officer directly. We do not use pre-ticked boxes for marketing consent.

3. AML/CTF Obligations (Identity Verification)

As a real estate agency, we are “Reporting Entities” under the AML/CTF Act.

  • Verification: We are legally required to verify the identity of vendors and purchasers (Know Your Customer/KYC). This involves collecting government-issued identification.
  • Retention: We are required by law to retain identity and transaction records for seven (7) years. This statutory requirement overrides any request for data deletion (Right to Erasure) during that period.

4. Technology Partners & Data Residency

To provide efficient and secure services, we utilise the following third-party providers. Your data may be stored on their secure servers:

  • AgentBox: Our primary CRM for client and property management.
  • Cotality: For property data, research, and valuation services.
  • DocuSign: For secure electronic signing of contracts and forms.
  • Gmail (Google Workspace): For secure email communication.
  • Dropbox: For encrypted cloud document storage.

Some of these providers may store data on servers located outside of Australia (e.g., USA or Singapore). By using our services, you consent to the disclosure of information to these overseas recipients under APP 8.

We take the security of your data seriously. To prevent unauthorised access:

  • Multi-Factor Authentication (MFA): We mandate MFA across all primary platforms (AgentBox, Gmail, Dropbox, and DocuSign).
  • Encryption: Data at rest and in transit is protected using industry-standard encryption.
  • No Biometrics: We do not currently collect or store biometric data (such as facial recognition or fingerprints).

6. Fair Trading & Transparency

In line with Fair Trading Obligations, we guarantee:

  • Transparent handling of your data (we do not sell lead lists to third parties).
  • Honest representation of property information.
  • Immediate notification of any “Eligible Data Breach” as required by the Notifiable Data Breaches (NDB) Scheme.

7. Cookies and Tracking
